Miami Auto Co privacy policy

This privacy policy has been compiled to better serve those who are concerned with how their "Personally Identifiable Information" (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

Who we are

Miami Auto Co is a car concierge and brokerage based in Miami, Florida, working with customers across the United States.

What this website collects on its own (from the implementation)

Very little. The pages on this site are static files.

  • We do not set cookies. If you switch the site between English and Spanish, your choice is saved in your browser's local storage so the site can remember it. It never leaves your device.
  • We use Cloudflare Web Analytics to count page views and visits. It is cookie-free, collects no personal information, does not fingerprint your device, and is not used for advertising. Cloudflare adds its measurement script at its own network edge, and does not add it for visitors in the European Union, so visits from the EU are not measured at all.
  • We do not run advertising, marketing pixels or social media trackers, and we do not use Google Analytics.
  • Fonts, images and our own scripts are served from this site. The one third-party script is Cloudflare's analytics script, described above.
  • The site is delivered by Cloudflare. Like any web host, Cloudflare processes your IP address and request details to serve the pages and protect against abuse, under Cloudflare's own privacy policy.

What personal information do we collect, and when?

When filling out a form on our site, you may be asked to enter your name, email address, phone number or other details to help you with your experience. We collect information from you when you fill out a form or enter information on our site. What each form asks for (from the implementation):

The forms are part of this site and send your answers directly to our own server.

  • Start My Search. First and last name, email, phone, whether you're looking to lease or finance, the make, model and trim you're interested in, whether you have a car to trade in, and anything else you want to tell us.
  • Trade-In (My Car). What you need help with, name, email, phone, the vehicle's VIN, year, make, model and trim, your current monthly payment, remaining payments and payoff amount, the current mileage, and the paperwork and photos you upload.
  • Credit Application. First, middle and last name, phone, email, Social Security number, date of birth, current address and how long you've lived there, type of residence and monthly housing payment, a previous address if you've been at the current one for under two years, employment status, employer, occupation, income, time at the job and employer contact details, a previous employer where required, an upload of a government-issued ID, and your agreement to the terms of service.
  • Business Credit Application. Everything in the Credit Application, plus the business name, address and phone, year established, tax ID, gross annual income and your position at the company.
  • File Upload. First and last name, mobile phone, a note saying what the file is, the files you upload, and your agreement to the terms of service.

Every submission also records the IP address it came from, the browser used, the page it was sent from, how long the form took to fill in, and the result of the bot check. Those details are used to stop spam and abuse.

How do we use your information?

We may use the information we collect from you when you fill out a form, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

  • To allow us to better service you in responding to your customer service requests.
  • To send periodic emails regarding your request or other products and services.
  • To follow up with you after correspondence (email or phone inquiries).

How do we protect your information? (from the implementation)

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. Specifically:

  • Storage. Submissions are stored on our own server, not on a third-party form service. Social Security numbers, dates of birth and business tax IDs are encrypted on disk (AES-256-GCM) with a key that is kept separately from the data. Everything you submit travels over an encrypted (HTTPS) connection.
  • The PDF. Each submission is turned into a PDF. The copy kept on our server is complete. The copy that is emailed to us has the Social Security number masked to its last four digits.
  • Email. When you submit a form, an internal notification with the masked PDF and any files you uploaded is sent to info@miamiautoco.com from a Gmail account we operate. You receive a confirmation from info@miamiautoco.com that contains your name, the form's name and a reference number, never your answers and never the PDF. Both mailboxes are provided by Google.
  • Our customer records. Each submission is matched to an existing customer record by phone number and email, or a new record is created. The masked PDF is attached to your record. The full Social Security number can only be revealed by an administrator, and every reveal is logged.
  • Uploads. Files you upload (PDF, JPG, PNG or HEIC, up to 15 MB each and six per form) are stored on our server and forwarded to us as email attachments.
  • Bot check. The forms are protected by Cloudflare Turnstile. To verify that a submission is not automated, Cloudflare receives the verification token and your IP address. Submissions are also rate-limited by IP address.
  • Previous website. Submissions made through the previous version of this website (on Wix and Formspree) can be imported into the same system, where they are handled the same way.

Identity verification

Because we work online and deliver to your door, we may ask you to verify your identity. If you agree, our verification provider, Stripe, collects photos of your driver's license or state ID and a selfie, checks that the ID is genuine, and compares the selfie with the photo on it. Stripe tells us the result: whether the check passed, the type of ID, the state that issued it, its expiration month, and whether your name — and, if you applied for credit with us, your date of birth and address — match what you gave us; we do not keep your date of birth, ID number or address from the ID. We keep copies of the photos of your ID and of your selfie, encrypted, with your customer file until 3 years after your last purchase or contact with us, and use them only to confirm your identity for your purchase and delivery; a copy of your ID (never the selfie) may be shared with those completing your purchase, such as the lender. We ask Stripe to delete the photos and the data it holds for us 30 days after the check; Stripe may keep some information under its own privacy policy (stripe.com/privacy), for example to prevent fraud. We never sell this information. To ask us to delete it, write to info@miamiautoco.com; to ask Stripe, use support.stripe.com.

Do we use "cookies"?

No. This website sets no cookies. If you choose a language, that choice is kept in your own browser's local storage and is never sent to us. If you clear your browser's site data, the site simply forgets the choice.

Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless we provide users with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property or safety.

We use service providers to run our business, including an artificial-intelligence service that helps our team draft replies, read the forms and documents you send us (such as applications, IDs and insurance cards) and organize records. A member of our team reviews every message before it is sent and every change the service suggests before it is saved. These providers process information only for us and do not use it to train their models.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

All the above categories exclude text messaging originator opt-in data and consent; this information won't be shared with any third parties.

Third-party links

We do not include or offer third-party products or services on our website.

Google

Google's advertising requirements can be summed up by Google's Advertising Principles. They are put in place to provide a positive experience for users. https://support.google.com/adwordspolicy/answer/1316548?hl=en

We have not enabled Google AdSense on our site but we may do so in the future.

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared.

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously.
  • Our Privacy Policy link includes the word "Privacy" and can easily be found in the footer of every page.
  • You will be notified of any Privacy Policy changes on our Privacy Policy page.
  • You can change your personal information by emailing us or by calling us.

How does our site handle Do Not Track signals? We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Does our site allow third-party behavioral tracking? It's also important to note that we do not allow third-party behavioral tracking.

COPPA (Children's Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

We do not specifically market to children under the age of 13 years old.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur: we will notify you via email within 30 days.

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CAN-SPAM, we agree to the following:

  • Not use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.
  • Include the physical address of our business or site headquarters.
  • Monitor third-party email marketing services for compliance, if one is used.
  • Honor opt-out/unsubscribe requests quickly.
  • Allow users to unsubscribe by using the link at the bottom of each email.

If at any time you would like to unsubscribe from receiving future emails, you can email us at info@miamiautoco.com or follow the instructions at the bottom of each email, and we will promptly remove you from ALL correspondence.

How long we keep your information

We keep the information you submit through our forms, including the backups that contain it, indefinitely. Nothing is deleted automatically.

To ask us to delete your information, email info@miamiautoco.com or call (305) 922-9023.

Calls, texts and WhatsApp

Consent to calls, text messages and WhatsApp messages, and how to opt out, is set out in the Submission Forms and Mobile Messaging sections of our Terms of Service. Your text-message and WhatsApp opt-in and consent are never shared with third parties (see Third-party disclosure above). WhatsApp messages travel through WhatsApp, which is operated by Meta and handles them under its own privacy policy.

Accessibility

We are committed to making our shopping experience available to all our customers, including those with disabilities, and have designed this website with accessibility in mind.

Need assistance or have feedback? If you notice any content, feature or functionality that you believe is not fully accessible to people with disabilities, please email us at info@miamiautoco.com with the words "Disabled Access" in the subject line and provide a description of the specific feature you feel is not fully accessible or a suggestion for improvement.
